What is mediation? How does it work?

Mediation is an effective way to resolve a disagreement. A confidential multi-step process that varies depending on the process determined and the particulars of the situation, mediation offers a forum for those who disagree to gain understanding, to be understood, and to work together to explore options for resolution. The process typically includes three steps:

  1. Pre-mediation, in which the professional mediator collects information from everyone involved and explains to both parties what to expect, who’ll be in the room, any paperwork involved, and the actual process.

  2. The actual Mediation session includes a review of the process, questions of both parties, brainstorming solutions or other options, and eventually an agreement if and as desired by all participants. Next steps are then determined.

  3. Post-mediation allows for follow-up with all parties based on agreements made in the mediation session. It’s not unusual to have more than one session, though the number may be limited in some cases. 

What are the benefits?

Quicker and much less expensive than a typical lawsuit, mediation offers everyone involved the chance to hear and understand each other’s point of view.
